Risk Warning
Risk Warning for the Port Macquarie Yacht Club
Issued under section 5M of the Civil Liability Act 2002
Participants are warned that, regardless of the precautions which might be taken by reasonable and experienced persons, sailing can be a dangerous pursuit and participants are exposed to significant risk of property damage, physical harm and possibly death. As an indication, these risks may include, but are not limited to:
- The vessel sinks or is unsafe to reman onboard.
- The vessel comes into contact with another vessel or object.
- Becoming separated from the vessel.
- Being trapped underwater as a result of vessel capsize or sinking.
- The failure of safety equipment to provide the required level of protection.
- Falling from heights, falling onto moving or hard objects.
- Physical injury through repetative actions, excessive strain or over exertion.
- Exposure to elements including the sun, wind, rain, lightning and the ocean.
- Contact with marine life including but not limited to marine stingers, insects, sharks and whales.
- The effects of sea sickness and resulting dehydration, nausea and health impact.
- Contact with overhead powerlines or under-sea cables.
- The failure of the vessel rigging, mechanical or structural components.
- Being struck or entangled with moving objects including but not limited to the rigging, sails and sheets.
- Pinch points including but not limited to sheet winches, hatches and rigging.
- Loss of personal items.
- Friction burns caused by ropes moving under load.
- The inexperience of other participants.
- The failure to adequately prepare for the conditions.
- The inaccuracy of weather forecasting.
- Absence of resources including adequate and timely medical or rescue services.
- Not having current or temporary membership of an affiliated Australian Sailing club.
- Exposure to communicable diseases including but not limited to COVID-19
Participants are warned to consider the above risks and all other risks before deciding to participate in any sailing event with the Port Macquarie Yacht Club
